ARTICLE 1 — APPLICATION PUBLISHER

The LudoGuide application (hereinafter "the Application") is published by:

ARTICLE 2 — PURPOSE AND ACCEPTANCE

These Terms of Use (hereinafter "ToU") define the terms and conditions under which any user (hereinafter "the User") may access the LudoGuide Application and use the services offered therein.

Access to and use of the Application is conditional upon prior and unreserved acceptance of these ToU. By downloading, installing or using the Application, the User acknowledges having read these ToU and fully accepts them.

The User declares having the legal capacity required to be bound by these ToU, or to act with the authorisation of a legal representative if necessary.


ARTICLE 3 — DESCRIPTION OF THE APPLICATION

LudoGuide is a mobile application available on iOS (Apple App Store) and Android (Google Play Store), designed for discovering and managing board game collections.

The Application offers in particular the following features:

Data relating to board games is sourced from BoardGameGeek (BGG), used in accordance with agreements concluded with that organisation and mentioned in the Application settings.


ARTICLE 4 — ACCESS TO THE APPLICATION

4.1 Technical access requirements

The Application is accessible from any compatible mobile device (iOS 16 minimum, Android 10 minimum) with an active Internet connection. The User is solely responsible for any connection costs incurred by using the Application.

The Publisher does not guarantee compatibility of the Application with all hardware and software configurations.

4.2 Account creation

Certain features require the creation of a user account. Registration can be done:

A temporary anonymous access may be granted to allow partial browsing before any formal registration.

The User guarantees the accuracy, completeness and regular updating of information provided during registration. The User is solely responsible for the confidentiality of their credentials. Any access to the Application from their account is presumed to have been made under their responsibility.

In the event of loss, theft or unauthorised use of their credentials, the User must notify the Publisher without delay at contact@ludoguide.fr.

4.3 Service availability

The Publisher endeavours to keep the Application continuously available. However, the Publisher reserves the right to suspend, interrupt or modify the Application at any time, in particular for maintenance, update or technical development reasons, without this giving rise to any right to compensation for the User.

4.4 Account deletion

The User may request the deletion of their account at any time, from within the Application interface or by writing to contact@ludoguide.fr. Deletion results in the immediate and irreversible erasure of all the User's personal data, under the conditions set out in Article 9. If an active subscription exists, the User is advised to cancel their subscription before deleting their account (see Terms of Sale, Article 8).


ARTICLE 5 — FEATURES AND PLANS

The following features are available for free, subject to a limit of ten (10) searches per day:

The "LudoGuide Unlimited" subscription (hereinafter "the Subscription") provides unlimited access to the following features:

ARTICLE 6 — USER OBLIGATIONS

By using the Application, the User agrees to:

Failure to comply with these obligations may result in the immediate suspension or termination of the User's account, without prejudice to any legal action.


ARTICLE 7 — INTELLECTUAL PROPERTY

7.1 Publisher's rights

The Application, its source code, architecture, features, graphical interfaces, texts, illustrations, logo and brand constitute works of the mind protected by French and international intellectual property law.

Any reproduction, representation, modification, adaptation, translation, distribution or exploitation, in whole or in part, of the Application or its elements, by any means, without the Publisher's prior written authorisation, is strictly prohibited and constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

7.2 BoardGameGeek data

Information relating to board games displayed in the Application (titles, descriptions, illustrations, statistics) is sourced from the BoardGameGeek (BGG) database and is used pursuant to an agreement with that organisation. This data remains the property of their respective authors and of BGG.

The Publisher claims no ownership rights over this data.

7.3 User content

Data entered by the User in the Application (game library, wishlist, loan information) remains the User's exclusive property. The Publisher claims no rights over this content beyond what is strictly necessary for the provision of the service.


ARTICLE 8 — THIRD-PARTY SERVICES

The Application integrates services provided by third parties. Use of these services is subject to each provider's own terms and conditions:

The Publisher accepts no liability for the practices, malfunctions or interruptions of these third-party services. Users are encouraged to consult the privacy policies and terms of each of these services.


ARTICLE 9 — PERSONAL DATA AND PRIVACY

Local storage data (theme, language, search preferences, search counter) is kept exclusively on the User's device and is never transmitted to the Publisher.

The Application does not use geographic location data.

9.3 Retention periods

Personal data is shared with the third-party providers listed in Article 8, strictly to the extent necessary for the performance of their services. No personal data is sold to third parties.

9.5 International transfers

Some providers (Google, Apple, RevenueCat, Sentry, Algolia, PostHog) may process data outside the European Union, in particular in the United States. Such transfers are governed by appropriate safeguards, notably the Standard Contractual Clauses (SCCs) approved by the European Commission, in accordance with Regulation (EU) 2016/679 (GDPR).

9.6 User rights

In accordance with the GDPR (Regulation (EU) 2016/679), Users have the following rights:

The Publisher undertakes to respond within one (1) month of receiving the request.

ARTICLE 10 — LIMITATION OF LIABILITY

10.1 Availability and accuracy

The Application is provided "as is". The Publisher does not guarantee:

10.2 Indirect damages

The Publisher shall not be liable for indirect, incidental, special or consequential damages resulting from the use of or inability to use the Application, including loss of data, revenue or business opportunities, to the extent permitted by applicable law.

10.3 External causes

The Publisher's liability is excluded in cases of force majeure, failure of a third-party service (Firebase, Algolia, RevenueCat, Sentry, PostHog, etc.), hardware failure of the User's device, or any event beyond the Publisher's reasonable control.

10.4 Consumer rights

The above limitations apply within the limits of the mandatory consumer protection provisions of the legislation applicable in the User's country of residence.


ARTICLE 11 — AMENDMENTS TO THE TERMS OF USE

The Publisher reserves the right to amend these ToU at any time. Updated ToU are published at https://www.ludoguide.fr/en/terms-of-use and in the Application settings, and take effect upon publication.

Continued use of the Application after publication of updated ToU constitutes acceptance of those ToU. Users are strongly advised to review the ToU regularly.


ARTICLE 12 — GOVERNING LAW AND DISPUTE RESOLUTION

These ToU are governed by and construed in accordance with French law.

In the event of a dispute relating to the interpretation, performance or termination of these ToU, the parties agree to seek an amicable solution before resorting to legal proceedings. To this end, the User may contact the Publisher at contact@ludoguide.fr.

If no amicable resolution is reached within thirty (30) days, the dispute shall be submitted to the competent French courts, without prejudice to the mandatory consumer protection provisions applicable in the User's country of residence.
